Voters passed Prop 207 in Arizona, making adult-use cannabis legal across the state. ABC15 interviewed Gary Smith for clarification on what the law allows, what it doesn’t and how Arizonans can avoid legal trouble.
Gary helps ABC15 viewers navigate the new legal territory surrounding cannabis use and possession:
- Individuals are not free to sell cannabis. Until businesses are licensed to sell recreational cannabis, the only way to legally obtain it would be to grow plants at home or for someone to donate plants to you. Moreover, Gary urges people to not buy cannabis off the street.
- There are limits to what people can grow. Prop 207 allows six plants per individual but no more than 12 per household — Gary explains that even if there are 20 people living in one house, they could only have a dozen plants.
- Cannabis is still illegal for anyone under age 21. Gary warns that although first and second-time offenders might get a pass or a fine, a third offence could result in charges filed.
