Although Americans have a Constitutional right to a jury trial, COVID-19 has many businesses reconsidering whether they want to spend time in a cramped courtroom. Writing for the Phoenix Business Journal, Gary Smith explained why businesses benefit from Maricopa County Superior Court’s recent measures to deflect cases to mediation and arbitration.
In addition to highlighting the pros and cons of mediation and arbitration, Gary shared what companies should look for in selecting a mediator or arbitrator. He also recommended companies revisit their form contracts to insert mediation and arbitration clauses that give them more control over dispute resolution.
Gary, who has a Certificate in Advanced Mediation from the Pepperdine University School of Law: Straus Institute for Dispute Resolution, is highly skilled in Alternative Dispute Resolution (ADR). He also has ample experience in arbitration, having handled construction design and defect, personal injury, contract disputes, and professional fees. He was appointed to the American Arbitration Association roster of neutrals for both Mediation and Arbitration and has taught ADR classes for the association.
